Regulations of the online bookstore

Online bookstore of University of Warsaw Press, operating at www.wuw.pl and www.wuw.pl/ksiegarnia is run by the University of Warsaw with headquarters: ul. Krakowskie Przedmieście 26/28, 00-927 Warszawa, NIP 525-001-12-66, Regon 000001258-00023
These Regulations specify the general conditions of using the Bookstore, in particular the submission, delivery of ordered products to the Customer, payment by the Customer of the products, the Customer's right to cancel the order and withdrawal from the contract, as well as the rules for submitting and examining complaints.
The Regulations are available free of charge via the website www.wuw.pl in order to provide the opportunity to read its content before concluding the Agreement.
I . Definitions
The terms used in the Regulations mean:
Client - a natural person, legal person or an organizational unit which is not a legal person, but the special provisions of which grant legal capacity, using the Bookstore, including in particular Orders;
Consumer - a client who is a natural person making purchases in a Bookstore to the extent not directly related to his business or professional activity;
Customer Account - a sub-page of the Bookstore with functionalities enabling the Customer in particular: management of current Orders, preview of completed Orders, change of personal and contact details, management of current complaints, preview of completed complaints;
Basket - the functionality of the Bookstore, in which the Goods selected by the Customer are visible and enabling the Customer to determine and modify the order data, in particular: the number of Goods, delivery address, invoice data, delivery method, payment methods.
Bookstore - University of Warsaw Press online bookstore, website available at www.wuw.pl and www.wuw.pl/ksiegarnia;
Goods - products (including products in electronic form) ordered by the Customer in the Bookstore;
Regulations - these Regulations ;
Seller - University of Warsaw with headquarters: ul. Krakowskie Przedmieście 26/28, 00-927 Warsaw;
Sales Agreement - a contract for the sale of Goods within the meaning of the Civil Code, concluded through the Bookstore between the University of Warsaw and the Customer;
Publisher - University of Warsaw Press with headquarters at ul. Prosta 69, 00-838 Warsaw;
Order - Customer's declaration of intent submitted via the form found in the Bookstore, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Good.
II. General rules of using the Bookstore
1. Minimum technical requirements enabling the use of the Bookstore:
- access to the Internet and Internet Explorer browsers, Google Chrome, Mozilla Firefox, Opera, Safari;
- access to an active e-mail account.
2. The Customer is entitled to use the Bookstore for its intended purpose and is obliged to refrain from any activity that could disrupt the proper functioning of the Bookstore.
3. Information about the Goods published in the Bookstore does not constitute an offer within the meaning of art. 66 of the Civil Code, and only an invitation to conclude an Agreement within the meaning of art. 71 of the Civil Code.
4. Viewing information about the Goods in the Bookstore does not require the creation of a Customer Account or other registration.
5. Acceptance of the Regulations is voluntary, but necessary to place an Order and make a purchase in a Bookstore or to create a Customer Account.

III. Order
1. The Customer may place orders for the Goods available in the Bookstore assortment seven days a week and twenty-four hours a day.
2. The condition of placing an Order is registration of the Customer Account within the Bookstore and acceptance of the Regulations.
3. Registration takes place by completing and accepting the registration form provided on one of the Bookstore's pages.
4. Registration of the Customer Account requires providing mandatory data necessary for the implementation of Orders placed by the Customer and reading and one-time confirming acceptance of the content of the Regulations. Registration of a Customer Account is free and possible without placing an Order.
5. Publisher may deprive the Customer of the right to use the Bookstore, as well as may limit his access to part or all of its resources, with immediate effect, in the event of the Customer's violation of the Regulations, and in particular if the Customer:
a) provided during registration data that were false, inaccurate or outdated, misleading or infringing the rights of third parties,
b) has violated the personal rights of third parties through the Bookstore,
c) has committed other behaviors that will be considered by WUP to be inconsistent with applicable law or general principles of using the Internet or detrimental to the good name of the Publisher.
6. A person who has been deprived of the right to use the Bookstore cannot register again without the Publisher's prior consent.
7. Orders can be placed by selecting the Goods and placing them in the Basket.
8. When placing the Order - until the "Order with obligation to pay" button is pressed - the Customer has the option of modifying the entered data and selecting the Good. To do this, follow the displayed messages and information available on the website.
9. After the Customer provides all necessary data, a summary of the placed Order will be displayed. The summary of the Order placed will contain information on:
a) the subject of the order,
b) unit and total price of ordered products or services, including delivery costs and additional costs (if any),
c) chosen payment method,
d) chosen method of delivery,
e) delivery time.
10. To place an Order, it is necessary to accept the Regulations, read the right to withdraw from the contract, provide personal data marked as mandatory and press the "Order with obligation to pay" („Zamówienie z obowiązkiem zapłaty”) button.
11. Placing an order is the submission by the Customer of an offer to conclude a Contract for the Sale of Goods being the subject of the order.
12. The customer receives a confirmation of the order and the order number via e-mail to the address provided by the customer when placing the order. The email confirming the acceptance of the order is tantamount to the acceptance by the Bookstore of the order placed by the Customer and conclusion of the Sales Agreement.
13. The sales contract is concluded in Polish, in accordance with the Regulations.
14. In the event that the Customer provides incorrect or inaccurate data, including in particular an incorrect or inaccurate address or blocking mail server administrators from sending messages to the address provided by the Customer, as well as deleting and blocking e-mails by software installed on the computer used by the Customer , Bookstore is not responsible for non-delivery or delay in delivery of ordered Goods to the fullest extent permitted by law.
IV. Payment
1. The binding price is the price of the Good given in the Basket when the Customer places the Order.
2. The price of the Good is the gross price given in Polish zlotys and does not include delivery costs.
3. In the case of Orders placed under the current promotions, they are implemented taking into account the discounts resulting from the terms of the specific promotion, calculated from the regular prices of the Goods at the time of placing the Order.
4. When placing the order, the Customer chooses the payment method from among the available options for the Good.
5. The choice of payment method affects the shipping cost, which is added to the cost of the Order. When placing the Order, the Customer is constantly informed about the total delivery costs of the Order.
6. The Bookstore reserves the right to disable the option of "cash on delivery" to a customer who does not collect two successively processed Orders, delivered by Poczta Polska or a courier. Restoration of the payment option "cash on delivery" for a given Customer will take place after receiving a shipment, carried out on the basis of the next Order, made using one of the prepayment options.
7. Shipping by postal order is only carried out in Poland.
V. Realization of the contract
1. Orders are carried out on business days from Monday to Friday according to the date specified in the Bookstore next to the presented Product at the time of placing the Order.
2. The term of the contract is counted from:
a) posting the full payment for the Order or additional payment to the current, incomplete payment for the Order (applies to Pre-paid orders),
b) Order confirmation (applies to orders with a "COD" payment method).
3. When placing an Order, the Customer selects one of the available delivery options in the Basket.
4. In the case of larger orders, the Bookstore reserves the right to process them in separate batches, after informing the Customer, while the shipping fee is charged only once..
5. Bookstore is not responsible for non-delivery of Goods or delay in delivery caused by incorrect or inaccurate address provided by the Customer.
6. The delivery of Goods is limited to the area of the Republic of Poland and takes place at the address indicated by the Customer when placing the Order.
VI. Withdrawal from the contract
1. The Customer, being a Consumer, has the right to withdraw from the Sales Agreement for up to 14 days, without giving any reasons.
2. The 14-day period for withdrawing from the Sales Agreement shall run from taking possession of the Goods by the Consumer or a third party indicated by him other than the carrier. If the Sales Agreement covers many Goods that are delivered separately, in batches or in parts from taking possession of the last item (Goods), the lot or part.
3. The Consumer withdraws from the Sales Agreement by submitting a statement of withdrawal from the contract and immediately, but no later than 14 days from the day on which he withdrawn from the contract, returning the Goods with proof of purchase (e.g. receipt, invoice) to the address: OSDW AZYMUT Sp . z o. o. Smolice 1 M / hala G 95-010 Stryków with the note: "Zwrot". Goods should be packed and secured so that they are not damaged in transit. The bookstore does not accept any packages sent on delivery..
4. A statement of withdrawal from the contract may be submitted in particular using the model form, attached to these Regulations or by submitting any other unequivocal statement informing about its decision to withdraw from the contract. A statement of withdrawal from the contract may be submitted via e-mail to the following address: dz.handlowy@uw.edu.pl or sent to the following address: Wydawnictwa Uniwersytetu Warszawskiego, ul. Prosta 69, VI p., 00-838 Warszawa.
5. In the event of successful withdrawal contract from a distance, the Sales Contract is considered void.
6. The Bookstore shall immediately, however no later than within 14 days from the date of receipt of the statement of withdrawal from the contract, return the Customer's payments, including the costs of the cheapest, usual method of delivery available in the Bookstore to deliver the Goods to the Customer. The bookstore will refund payments using the same method of payment that the Customer used, unless he explicitly agreed to a different method of return.
7. The Customer is responsible for reducing the value of the returned Goods as a result of using them in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods. The Seller reserves the right to claim damages against the Customer, to the extent permitted by applicable law.
8. The right to withdraw from the contract is not available in the case of a contract in which the subject of the service are:
a) sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery;
b) digital content, not saved on a tangible medium, if the performance of the service began with the express consent of the Customer, before the deadline to withdraw from the contract;
c) newspapers, periodicals or magazines, with the exception of subscription contracts.
VII. Complaints
1. The Customer may complain about Goods with manufacturing defects or incompatible with the order, describing the reasons for the complaint and presenting proof of purchase.
2. The Customer shall send the complained Goods immediately to the following address:
OSDW AZYMUT Sp. z o. o. Smolice 1 M / hala G 95-010 Stryków with the note: „Reklamacja”. The Bookstore does not accept any packages sent on delivery..
3. The Bookstore considers complaints immediately after receiving information about it and the parcel with the advertised Goods.
4. If the Bookshop accepts the complaint, the defective Goods will be exchanged for a full-fledged one, and if this is not possible, the Bookstore will offer other available Goods to choose from or refund the price of the goods along with the shipping costs to the Customer.
5. If the complaint is accepted by the Bookstore, the Seller shall issue an appropriate correcting invoice without delay and send it to the Customer at the indicated address.
VIII. Rules for selling electronic files
1. An order that includes electronic files cannot be combined with an Order that includes other Goods available in the Bookstore,creating a separate Basket. An individual Order may contain only one copy / piece of a given electronic file.
2. When placing an Order, the Customer should become acquainted with the technical requirements, description of a given Good, which contains, among other data, provisions on the scope of the license for a given file and the type of file.
3. The Customer before placing an Order is obliged to check whether his electronic device together with the software installed on it, intended for the use of an electronic file and its download, meets the minimum technical requirements enabling the download and use of an electronic file.
4. After receiving the confirmation of payment, the Bookstore will immediately, but no later than within 48 hours, send to the e-mail address provided by the Customer a confirmation of receipt of payment and information on how to download the electronic file, as well as (invoice attached as an attachment) VAT. At the Customer's request, the Bookstore will send a VAT invoice in paper form via the Polish Post Office to the given correspondence address.
5. If the Order cannot be completed, the Bookstore will inform the Customer about it via e-mail to the address provided by the Customer. If the Customer pays the Order, the Bookstore will refund the deposited funds to the bank account indicated by the Customer.
6. The Customer who is a Consumer has the right to withdraw from the Agreement within 14 days of its conclusion - unless he has agreed to be provided with an electronic file before that date and has been informed that by expressing this consent he has lost the right to withdraw from the Agreement. The right to withdraw from the contract expires in this situation at the moment of providing the Customer with information on how to download the ordered electronic file in such a way that its download depends only on his will.
7. To the extent not regulated in this section, the provisions of other sections of the Regulations shall apply accordingly.
IX. Privacy policy
1. The administrator of your personal data is the University of Warsaw with headquarters at Krakowskie Przedmieście 26/28, 00-927 Warszawa;
2. The Data Protection Officer of the University of Warsaw oversees the correctness of personal data processing and can be contacted via the e-mail address: iod@adm.uw.edu.pl;
3. Your personal data will be processed in order to perform the order;
4. The data provided will be processed on the basis of art. 6 par.1 a;
5. Providing data is voluntary, but necessary to achieve the purposes for which they were collected;
6. The data will be made available to external entities in cases provided for by law, and on the basis of the entrustment agreement will be transferred to the following entities:
7. The data will be stored for the period necessary to perform the sales contract and in addition for 5 years from the beginning of the year following the financial year in which operations, transactions, proceedings were finally completed, repaid, settled or expired;
8. You have the right to access your data and subject to legal provisions: the right to rectify, delete, limit processing, the right to transfer data, the right to object, the right to withdraw consent at any time;
9. You have the right to lodge a complaint with the President of the Office for Personal Data Protection;
10. Your data will not be processed in an automated manner and will not be profiled.
X. Final arrangements
1. In matters not covered in the Regulations, the rules of Polish law, in particular the Civil Code and the rules of the Act of 30 May 2014 on consumer rights (consolidated text of 24 June 2014, Dz. U. z 2014 r., poz. 827), the Act on the provision of electronic services of July 18, 2002 (Dz. U z 2013 r poz. 1422 z zm.), Act of August 29, 1997 on the protection of personal data (Dz. U. Nr 133 poz. 883 ze zm.).
2. The Publisher reserves the right to change the Regulations. All changes to the Regulations are effective from the date of their publication in the Bookstore. Orders placed by Customers prior to the entry into force of amendments to the Regulations are implemented according to the existing provisions of the Regulations.

3. The Customer before placing an Order is obliged to check whether his electronic device together with the software installed on it, intended for the use of an electronic file and its download, meets the minimum technical requirements enabling the download and use of an electronic file.
4. After receiving the confirmation of payment, the Bookstore will immediately, but no later than within 48 hours, send to the e-mail address provided by the Customer a confirmation of receipt of payment and information on how to download the electronic file, as well as (invoice attached as an attachment) VAT. At the Customer's request, the Bookstore will send a VAT invoice in paper form via the Polish Post Office to the given correspondence address.
5. If the Order cannot be completed, the Bookstore will inform the Customer about it via e-mail to the address provided by the Customer. If the Customer pays the Order, the Bookstore will refund the deposited funds to the bank account indicated by the Customer.
6. The Customer who is a Consumer has the right to withdraw from the Agreement within 14 days of its conclusion - unless he has agreed to be provided with an electronic file before that date and has been informed that by expressing this consent he has lost the right to withdraw from the Agreement. The right to withdraw from the contract expires in this situation at the moment of providing the Customer with information on how to download the ordered electronic file in such a way that its download depends only on his will.
7. To the extent not regulated in this section, the provisions of other sections of the Regulations shall apply accordingly.
IX. Privacy policy
1. The administrator of your personal data is the University of Warsaw with headquarters at Krakowskie Przedmieście 26/28, 00-927 Warszawa;
2. The Data Protection Officer of the University of Warsaw oversees the correctness of personal data processing and can be contacted via the e-mail address: iod@adm.uw.edu.pl;
3. Your personal data will be processed in order to perform the order;
4. The data provided will be processed on the basis of art. 6 par.1 a;
5. Providing data is voluntary, but necessary to achieve the purposes for which they were collected;
6. The data will be made available to external entities in cases provided for by law, and on the basis of the entrustment agreement will be transferred to the following entities:
- OSDW Azymut Sp. z o.o., ul. Gottlieba Daimlera 2, 02-460 Warszawa
- RavNet Sp. z o.o., ul. Płochocińska 19, 03-191 Warszawa;
- PayPro SA, ul. Kanclerska 15, 60-327 Poznań
7. The data will be stored for the period necessary to perform the sales contract and in addition for 5 years from the beginning of the year following the financial year in which operations, transactions, proceedings were finally completed, repaid, settled or expired;
8. You have the right to access your data and subject to legal provisions: the right to rectify, delete, limit processing, the right to transfer data, the right to object, the right to withdraw consent at any time;
9. You have the right to lodge a complaint with the President of the Office for Personal Data Protection;
10. Your data will not be processed in an automated manner and will not be profiled.
X. Final arrangements
1. In matters not covered in the Regulations, the rules of Polish law, in particular the Civil Code and the rules of the Act of 30 May 2014 on consumer rights (consolidated text of 24 June 2014, Dz. U. z 2014 r., poz. 827), the Act on the provision of electronic services of July 18, 2002 (Dz. U z 2013 r poz. 1422 z zm.), Act of August 29, 1997 on the protection of personal data (Dz. U. Nr 133 poz. 883 ze zm.).
2. The Publisher reserves the right to change the Regulations. All changes to the Regulations are effective from the date of their publication in the Bookstore. Orders placed by Customers prior to the entry into force of amendments to the Regulations are implemented according to the existing provisions of the Regulations.
